The Australian Dental Association Queensland Branch (ADAQ) is the peak professional membership body for dentists in Queensland.

Position overview

Reporting to the CEO, the General Counsel will have a strong focus on governance, compliance management, will provide expert and strategic legal advice to management and the Board (Council). You will ensure the organisation operates within the law at all times, offer counsel on legal issues and ensure legal compliance and limit risk exposure across the business.

This position provides a full suite of legal services including legislative interpretation, tendering, leases and licences, contract and workplace law, commercial transactions, brand and intellectual property rights and insurance and liability issues. This position also manages the outsourcing of legal services although there is an expectation that this will only be required in limited circumstances in specialised areas of law or litigation.

Key responsibilities

Legal

• Provision of in-house legal advice to the CEO, Executive and senior managers;
• As required to review and assess contracts, leasing documents and other legal documents;
• Represent ADAQ in negotiations and mediations when/as appropriate;
• Reporting to the Board on legal and compliance matters
• Provide support and education for ADAQ team members on matters relating to risk management (including legal risk management)
• Develop, monitor and support legal compliance and advise on the legal aspects of policy development to ensure consistency across all legal matters including interpretation of legislation, commercial transactions and tendering, contract law and all applicable regulatory matters.

Workplace Health & Safety

• Responsible for ensuring ADAQ complies with its legal requirements and strives for best practice in the provision of a safe workplace for all.

Insurance and Advice

• Managing the ADAQ dental insurance scheme including overseeing the processing of renewals and advising on insurance claims.
• Direction and oversight of compliance advice to ADAQ members

Policy & Advocacy

• Provide advice and support to the Dental Practice Committee in developing submissions as appropriate.
• Develop policy and advocacy positions to improve the standing of the Dental profession in Queensland

Key selection criteria

• At least 8+ years experience in providing corporate/ commercial legal advice in the healthcare industry.
• At least 3 years’ experience in managing corporate governance and risk management systems
• Proven ability to formulate legal solutions and to minimise and avoid exposure
• Excellent stakeholder management, analytical and negotiation skills, with the ability to work with non-lawyers to achieve outcomes
• Demonstrated ability to exercise high level judgement and discretion, and to manage corporate compliance, contractual and legal issues in a not-for-profit/ for purpose environment.
• Tertiary legal qualification and holding or being eligible to hold a current practising certificate as an Australian lawyer.
